Commercial litigation is the conduct of a plaintiff bringing a lawsuit against a defendant in response to received damages as part of commercial transactions. Commercial transactions deal with exchange of goods and services with economic value from producer to consumer. Accordingly, commercial litigation deals with received damages as part of the exchanges of goods and services from producer to consumer.

Commercial litigation is necessary as the plaintiff feels compelled to bring a lawsuit against the defendant in order to receive adequate compensation for damages received. Accordingly, commercial litigation involves dispute resolution between parties involved concerning damages received as a result of consumer transactions.

Dispute resolution can involve extrajudicial processes known as alternative dispute resolution (ADR). Generally, there are four types of ADR classifications used in commercial litigation: negotiation, mediation, arbitration, and collaborative law. The benefits of ADR in commercial litigation include avoiding an overloaded court system, perceived fewer costs, confidentiality, and increased control over the process. Additionally, some courts require ADR before a case can be tried.

Commercial Law

Commercial law governs business and commercial transactions including those requiring commercial litigation. Commercial law is a branch of civil law referring to disputes between individuals and/or organizations in which compensation may be awarded to a victim. Since the exchange of goods or services from producer to consumer in commercial transactions may result in damages received, compensation may be necessary. In such circumstances, commercial litigation provides a means for dispute resolution and adequate compensation.

Commercial law also deals with issues of public and private law. Public law governs the relationship between individuals and the state or government. Accordingly, commercial law includes issues of constitutional law, administrative law, and criminal law. Conversely, private law governs relations between individuals or groups not including intervention of the state or government. Accordingly, commercial law involves litigation between individuals in response to a loss of economic value during an exchange of goods or services where the transaction involves either a private or public producer or consumer.
