Generally, there are four types of ADR classifications used in commercial litigation: negotiation, mediation, arbitration, and collaborative law. The benefits of ADR in commercial litigation include avoiding an overloaded court system, perceived fewer costs, confidentiality, and increased control over the process. Additionally, some courts require ADR before a case can be tried.
