The judge denied the defendants’ motion to dismiss claims for negligence, strict product liability, breach of implied warranty and violation of various state consumer protection laws. The ruling is a milestone for plaintiffs who were exposed to paraquat and now suffer from Parkinson’s disease.

Judge Rosenstengel ordered Defendants to produce all discovery requests and responses, non-expert witness deposition transcripts and exhibits, expert reports, and pleadings that were prepared in the Hoffman litigation to plaintiff lawyers in the multidistrict litigation (MDL) and California Judicial Council Coordination Proceedings. This order will likely speed up the MDL and help bring cases to trial sooner.
