Olympus Surgical Scope Infection Lawsuit

Did you or a loved one develop a serious infection following a diagnostic or preventative endoscope procedure?
You may be eligible for compensation

Surgical scope-maker Olympus may be facing numerous lawsuits regarding serious infections developing after patients have undergone certain medical procedures using an Olympus endoscope or duodenoscope. These surgical instruments are small cameras designed as part of a flexible tube which can look into the gastrointestinal system by inserting the scope down the throat or into the colon.

You may qualify if:

  • You (or a loved one) had a qualifying procedure using an Olympus scope;
  •  The procedure occurred in or after 2015;
  • Developed a serious infection (including sepsis, organ failure, death, or tuberculosis) within 30 days of the scope procedureor
  • Were diagnosed with HIV following a scope procedure.

Qualifying procedures may include:

  • Endoscopy (including upper endoscopy/gastroscopy);
  • Enteroscopy;
  • Colonoscopy; and
  • Bronchoscopy.

Numerous warnings have been issued by the U.S. Food and Drug Administration since 2015, also involving hundreds of injuries and at least one death associated with Olympus scope infections.

What’s the issue?

Manufacturers of Olympus reusable endoscopes and duodenscopes may have created devices which could not be fully sterilized between uses even when proper sterilization procedures are followed by hospitals and surgical centers.

The Olympus reusable scopes contain internal channels and mechanical components which may trap bacteria and microorganisms, remaining in the device to be transferred to the next patient. This may result in serious infection in patients who have undergone a scope procedure with an Olympus device.

Reported complications may include:

  • Bloodborne infections including HIV and tuberculosis
  • Sepsis
  • Organ failure
  • Extended hospitalization
  • Death

People or loved ones of those who underwent a scope procedure using an Olympus scope instrument after 2015 and developed a serious infection, sepsis or other related injury within 30 days may be eligible for compensation.

  • About Seeger Weiss

    Seeger Weiss is best known for multidistrict mass torts and class actions in both state and federal court. From offices in New York, New Jersey, and Pennsylvania, and Florida, the firm has represented over 10,000 individuals, companies, and governments across the U.S. who have been injured or defrauded on a massive scale.

    Since its founding in 1999, it has led many of the most complex and high-profile cases in the country: the National Prescription Opiate Litigation; 3M Combat Arms Earplug Products Liability Litigation; the ongoing “Dieselgate” scandal; the sprawling multistate litigation on behalf of survivors of child sexual abuse; and the Football League Players’ Concussion Injury Litigation.

  • Who am I talking to when I call Seeger Weiss?

    Almost of our calls are initially handled by our talented reception team. Depending on the nature of the call, they may connect you to one of Seeger Weiss’s intake specialists (for prospective clients) or to one of our case management paralegals (for current clients). These teams are here to answer your questions, provide context, and help guide you through process of becoming a client or of pursuing your case in court.

  • Do I have to pay?

    The vast majority of the work Seeger Weiss does is on a contingency basis. That means we are paid only once we have secured financial compensation via trial or settlement—usually a percentage of the total award. Individual retainer agreements, which prospective clients must review and sign to retain Seeger Weiss as their legal representation, will share information on how your contingency fee works.

  • I just signed a retainer, what happens next?

    Once you’ve signed a retainer agreement with Seeger Weiss, the firm becomes your legal representation. For the firm, our next step is to gather as much information about your case as possible. Typically, that means you’ll sign authorization forms that allow us to speak on your behalf to or obtain information from other organizations and institutions, such as a primary care physician’s office or a hospital.
