SELECTED REPRESENTATION

  • Represented plaintiffs in MDL against Syngenta AG, a Swiss agrochemical giant, for premature commercialization of genetically modified strains of corn known as Agrisure Viptera and Duracade. Plaintiffs were awarded $217.7 million in compensatory damages in a Kansas class-wide trial, leading to a preliminary nationwide settlement of $1.5 billion announced in September 2017. Involvement included substantial discovery responsibilities including direct communication with bellwether plaintiffs, drafting discovery responses, and assistance with deposition.
  • Represented plaintiffs in MDL against Depuy Orthopaedics, Inc., a subsidiary of Johnson & Johnson, regarding claims concerning defective design, failure to warn, and unfair and deceptive trade practices concerning their ASR hip implant product, resulting in an almost $3 billion settlement. Involvement included discovery and assisting in preparation of corporate witness depositions.
  • Represented plaintiffs in MDL against Merck & Co., specifically the drug Vioxx, for product liability claims involving increased cardiovascular side effects and a lack of adequate physician and consumer warning. Involvement included discovery, including overseeing of document review process and management of depository.
