Panasonic Cordless Telephone Class Action

This nationwide class action lawsuit was filed on behalf of purchasers of Panasonic's series KX-TG (900 MH) and KX-TC (2.4 GHz) cordless telephones. The consumer plaintiffs - on behalf of themselves as well as other phone purchasers throughout the United States - charged Panasonic with knowingly marketing defective cordless phones to purchasers throughout the country.

The complaint alleged claims under the New Jersey Consumer Fraud Act ("NJCFA"), specifically, that Panasonic engaged in an unconscionable commercial practice by marketing, selling, and distributing through its New Jersey headquarters the KX-TG and KX-TC phones that contained common defects. Plaintiffs also contended that Panasonic knowingly concealed the defects in the phones from consumers who would not have bought the phones had they been aware of the defects, in violation of the NJCFA. In June 2004, Seeger Weiss overcame Panasonic's motion to dismiss and, in late July 2004, the New Jersey Appellate Division denied Panasonic's motion for leave to appeal the dismissal motion. The trial court declined to certify the case as a class action because the variety of defective phone products that were at issue.
