Complex Legal Services

For many clients, multi-district litigation is preferable to individual trials because the cases are consolidated nationwide and avoid having divergent decisions being made. If not assigned to a single judge who is an expert in the field, cases can sometimes favor the litigants while other cases can favor the defendants, both of which can weaken subsequent, tag along, cases.

Businesses also prefer multi-district litigation because resources for the complex legal services can be grouped together and discovery and pretrial motions can be streamlined saving them time and money.

While these types of cases are handled more efficiently, they still require legal representation with a history of providing complex legal services and ensuring the process is seen through correctly and completely. Contact Seeger Weiss for more information.

Pros and Cons for Parties Involved

Pros for defendants: For large corporate defendants, it is usually cheaper and easier to litigate complex legal services in front of one court instead of in numerous courts. Defendants also don't like their witnesses to be deposed many times, which is what happens if numerous lawsuits are not consolidated. Multiple depositions can increase the likelihood of inconsistent answers by witnesses.

Cons for defendants: On the other hand, publicity surrounding multi district litigation can prompt new plaintiffs to file lawsuits—a negative for defendants.

Pros for plaintiffs: Plaintiffs' attorneys can pool their complex legal services and coordinate efforts, increasing the money and human resources available to litigate cases . The consistency in legal rulings is also a plus for them, i.e., a defective drug case might have affected over a 100 litigants from different locations and could literally go before 100 different judges; whereby, having the strong possibility of divergent decisions and more time and money necessary to reach settlements.
