Seeger Weiss Files Suit over Faulty Coleman DGU Series Furnaces
February 25, 2011
On February 25, 2011, Seeger Weiss filed a class action lawsuit on behalf of a Pennsylvania man who purchased a faulty Coleman DGU Series Furnace, against the York International Corporation.
The York International Corporation designed and manufactured the Coleman DGU Series Furnaces, a link that contained a defect in a component called the Hot Surface Igniter. During normal use, condensation builds up in the furnace. When water touches the Hot Surface Igniter, the component cracks. Once damaged in this way, the Hot Surface Igniter cannot generate sufficient heat to ignite the fuel supplied to the furnace. If the fuel cannot be ignited, the furnace does not operate.
The York International Corporation knew of the defective Hot Surface Igniter, and redesigned the component in 2003 to include a protective guard that effectively prevents it from coming into contact with water and cracking. The Coleman DGU Series Furnaces with the upgraded Hot Surface Igniter had an almost nonexistent rate of failure. While the York International Corporation knew of the original defect, it failed to disclose the original problem to its customers or replace with original defected Hot Surface Igniter with the upgraded version. Moreover, the York International Corporation continues to sell furnaces with the faulty component. The case was filed in the U.S. District Court, Eastern District of Pennsylvania.
