Jury Awards $5.5 Million in Bellwether Victory for Pain Pump Litigation

The first of hundreds of pain pump lawsuits to proceed to trial ended in a huge victory for the plaintiff last week. Seeger Weiss LLP is part of the litigation group working in coordination to bring these cases to court across the country.In Portland Oregon, a state court jury awarded $5.5 million to the injured plaintiff, a 38-year-old father of four whose arm has been disabled, and who has been left in constant pain since the I-Flow pain pump destroyed the cartilage in his right shoulder.
The I-Flow corporation encouraged doctors to use the pain pump for shoulder surgeries without testing the safety of the pump for that use, and without FDA approval. I-Flow formally called the FDA to approve the device for shoulder-joint surgeries three times. All three times, the FDA denied their requests. Despite this clear message from the FDA, I-Flow issued a press release claiming that the FDA had approved their pain pump for orthopedic use – in bold violation of the truth.
In the upcoming months, several more pain pump cases are scheduled for trail, against I-Flow and other manufacturers. This recent verdict from Oregon is sure to give many victims of I-Flow’s callous and dishonest marketing ploys hope as they await their day in court.
