Seeger Weiss LLP Investigates AT&T Data Plan Tax Overcharges
February 10, 2010
AT&T improperly charges data plan customers taxes for internet connectivity for their iPhone, Blackberry, other smart phone, or for their 3G-capable laptop. The Internet Tax Freedom Act provides that no state or local government may tax fees charged for internet access, yet AT&T still collects a tax fee for each data plan subscription.
In recent years, AT&T has become one of the largest providers of cellular phone and wireless network service in the world. Much of this can be attributed to the release of the ground-breaking Apple iPhone, which when introduced, offered service exclusively through AT&T. In addition to the iPhone, AT&T also offers consumers several other kinds of cell phones and service plans. One of the most popular features as part of their cellular phone/wireless network service is a data plan, which allows customers to access the Internet from their wireless devices.
AT&T markets their data plan packages on their cell phone/wireless network with several options, including unlimited data usage and transfers. Once the customer selects a data package, it is then added to their service plan, and appears as an additional charge on the customers’ monthly bill. With the exception of unlimited data usage and transfers, if customers exceed the specified amount that was agreed upon in their data service plan, they will be charged an additional amount for that data usage. Research has now shown that the amounts of data and transfers that customers are using is being incorrectly measured, thus inflating the amounts by 3 to 5 times higher than what is actually should be. As a result, customers are receiving inaccurate bills, and are charged too high an amount each month.
