What to Do First for Accident Injury Claims
To ensure that their client's accident injury claims are successful, attorneys of Seeger Weiss suggest victims do three things within the first 72 hours following an accident.1. Notify your insurance company.
You’ll want to share the facts with them even if your accident claim will be directed toward another party who caused the accident. This step will protect you against the unexpected. It is not always obvious after an accident who will be responsible—and able—to pay for your damages.
2. Return to the scene and locate any evidence or witnesses.
Physical evidence supporting accident injury claims that are not preserved in the first few days following an accident can get lost, modified by time or weather, destroyed or repaired. So do your best to gather it and preserve it—as it was at the time of the accident—as proof for your accident claim. Another option is to photograph the damage and make sure that the date is indicated on the back of the prints, on your receipt, or on the digital file. Both physical evidence and photos are difficult to contradict in an accident injury claim. Types of evidence can be:
- A broken stair that caused a fall
- An overhanging branch that blocked visibility
- A damaged car or bike
- Damaged clothes, or
- A defective product
For accident injury claims where someone else is at fault, the person or business, through its insurance, will be obligated to repay you for all reasonable medical expenses as well as pain and suffering caused by your injuries.
Too often people try to do without medical care, or report to a doctor only what seems to be their worst injury. For accident claims, it is extremely important to report all injuries, pains and discomfort. So don’t hesitate to seek medical help and keep all documents concerning medical treatment, diagnosis, and billing.
