Seeger Weiss LLP is Co-Counsel to a proposed class of New Jersey small businesses and residential customers whom Verizon charged for non-dial tone services for "Special Circuits" that were either non-existent or non-operational. Special Circuits create a connection via the Verizon network between the end-user's location and a service provider, such as a police or fire station, or an answering service or data center. Plaintiffs allege that even though it knew that a circuit was non-existent or non-operational (often as a result of it having been removed) Verizon nevertheless continued to charge customers for the use of a Special Circuit, in violation of the New Jersey Consumer Fraud Act. Plaintiffs' counsel recently defeated Verizon's attempt to have this case dismissed or heard in front of the New Jersey Board of Public Utilities.
