Toyota and Lexus Sudden Unintended Acceleration Recall - Seeger Weiss LLP

Seeger Weiss LLP is investigating injuries and deaths relating to sudden unintended acceleration in several different models of cars manufactured by Toyota.

Vehicles Involved in the Recall

  • Toyota Camry: 2007 – 2010
  • Toyota Prius: 2004 – 2009
  • Toyota Avalon: 2005 – 2010
  • Toyota Tundra: 2007 – 2010
  • Lexus ES 350: 2007 – 2010
  • Lexus IS 250 and IS 350: 2006 – 2010

Additional problems have been reported with earlier model years, as well as with other models including: Lexus ES 300 and 330s, Camry Solara, Sienna, Tacoma and RAV4.

Toyota maintains that the problem is caused when the all-weather (rubber) floor mat (standard issue in some vehicles, optional equipment in others) becomes wedged on top of the accelerator and causes the acceleration (“Floor mat interference”). However, many independent experts believe that the problem is a defective engine throttle control system – not the floor mats. Some incidents of sudden unintended acceleration have occurred when the floor mats were in the trunk of the car.

Models possibly affected by a defective throttle control system

  • 2000 Toyota Avalon, Toyota Sienna
  • 2001 Lexus RX300, Toyota Avalon, Toyota Highlander, Toyota Sienna
  • 2002 Lexus ES300, Lexus RX300, Toyota Avalon, Toyota Camry, Toyota Sienna, Toyota Highlander, Toyota Solara
  • 2003 Lexus ES300, Lexus RX300, Toyota Avalon, Toyota Camry, Toyota Highlander, Toyota Sienna, Toyota Solara
  • 2004 Toyota Avalon, Toyota Camry, Toyota Solara
  • 2005 Toyota Camry, Toyota Highlander, Toyota RAV4, Toyota Solara
  • 2006 Toyota Camry, Toyota Higlander, Toyota RAV4, Toyota Solara
  • 2007 Toyota Camry, Toyota Highlander, Toyota RAV4, Toyota Solara
  • 2008 Toyota Camry, Toyota RAV4, Toyota Solara
  • 2009 Toyota Camry, Toyota Corolla, and Toyota Matrix

Since 2001, more than 1,000 drivers have reported sudden unintended acceleration in Toyota and Lexus vehicles to National Highway Traffic Safety Administration. There are records of at least 19 deaths involving sudden unintended acceleration in Toyota and Lexus car, and countless injuries. According to the LA Times, independent safety expert Sean Kane, president of Safety Research and Strategies, has identified nearly 2,000 sudden-acceleration cases for Toyota vehicles built since 2001.
