Class Action Lawsuit Against CertainTeed - Shingle Product Defects
Seeger Weiss LLP filed a class action lawsuit against CertainTeed Corporation, after a recent investigation pertaining to defects in the design, manufacture, advertising and sale of their shingle products. This consumer class action was filed on August 31st, 2006 in the United States District Court for the Southern District of Iowa.
This page is designed to inform purchasers of CertainTeed shingles and other interested parties about the litigation, and to provide consumers with a means to assist counsel in prosecuting the case on their behalf by sharing their experiences in the questionnaire below.
Complaints have been filed in Iowa and Pennsylvania. Both allege that the shingles fail to perform as marketed in that moisture invasion destroys the their ability to prevent water damage sooner than is reasonably expected. Because of this defect the shingles regularly deteriorate, blister, crack and curl in advance of the expiration of CertainTeed's warranty periods.
The complaints allege that CertainTeed knowingly and intentionally concealed and failed to disclose that they actually had no intention of providing the services set forth in their warranties. Similarly, CertainTeed has failed to implement any changes to their shingle procedures or warranty procedures to remedy the defects.
CertainTeed is a large building materials manufacturer that produces shingles that are later branded as Horizon, Independence, Hearthstead, Hallmark, Woodscape, Sealdon and War-Sealdon.
