Seeger Weiss LLP Commences Personal Injury and Consumer Class Actions Following Recall of Hydroxycut Products

Seeger Weiss LLP announced that it will be commencing personal injury actions and consumer fraud claims on behalf of those victims who suffered personal injury and/or economic losses resulting from their purchase and ingestion of the dietary supplement, Hydroxycut.
On May 1, 2009, the FDA announced a recall of 14 different Hydroxycut products, following at least 23 reports of liver problems, including one death of a 19-year-old boy. This death occurred in 2007 but does not appear to have been reported to the Agency until last month. At least one patient has required a liver transplant. The FDA warned dieters and body builders to immediately cease use of the weight loss products. Symptoms of liver damage include jaundice, a yellowing of the skin or eyes, brown urine, nausea, vomiting, excessive fatigue, weakness, stomach pain, itching and loss of appetite. Other health problems have also been reported, including: seizures, cardiovascular disorders and rhabdomyolysis, a form of muscle damage that can cause kidney failure.
Hydroxycut is manufactured by Iovate Health Sciences, Inc. and distributed under the Iovate and Muscletech brand names. Hydroxycut is estimated to account for nearly 90 percent of the market for weight loss supplements and sold a reported nine million packages last year through pharmacies and grocery stores. Dietary supplements, such as Hydroxycut, do not require FDA approval before they are marketed and are not monitored as closely as prescription medications.
