Vehicle Repossession Abuse

The current economic outlook is worse than it has been in generations; unemployment has risen, and many have seen their income plummet along with other economic indicators. Payments on mortgages and vehicles become harder as money must be put to use for food and fuel first. In these dire circumstances, many consumers' cars, trucks or motorcycles may be repossessed and the bank or finance company is attempting to collect additional funds, often referred to as a deficiency judgment. Too often, lenders use these unfortunate circumstances to take advantage of consumers who owe money.

The Rules of Fair Play

Under laws applicable in each State, any bank or finance company seeking to repossesses and sell vehicles at auction and charge a remaining balance (referred to as a deficiency) must comply with a highly regulated and strict process designed to protect the consumer's interests. If they do not follow these procedures precisely and to the letter of the law, the consumer may be entitled to the return of their vehicle or a reduction, or in some instances, a complete elimination of any outstanding amounts due.
