Marc S. Albert focuses his practice on personal injury and medical malpractice litigation. Highly experienced in the handling of complex matters, Mr. Albert spends most of his time representing individuals who have suffered catastrophic injuries as a result of the negligence of another. In particular, Mr. Albert has vast experience in the litigation of cases involving construction site accidents, motor vehicle accidents, trucking accidents, boating accidents, wrongful death, premises liability, products liability and medical malpractice.

Mr. Albert graduated from University of Wisconsin-Madison in 1992 with a Bachelor of Arts degree. He earned his law degree from New York Law School in 1995. Since this time, Mr. Albert has dedicated his practice of law to the representation of injured parties. He joined the Seeger Weiss team in March, 2003.

Mr. Albert plays an integral role in the firm’s thriving personal injury practice. During his tenure at Seeger Weiss, he has been responsible for obtaining numerous seven-figure recoveries for injured clients, several of which were in high profile cases that were widely reported by the press. Some of the recent cases of note included a $1 million recovery for a construction worker injured while working in a trench at Ground Zero, a confidential seven-figure settlement on behalf of 11 children who were injured as a result of abuse by staff at a public act school and a $2.9 million recovery for the family of a man who was tragically killed in a boating accident.

In January, 2009, Mr. Albert obtained a $3.25 million settlement on behalf of a 10 year old boy who suffered brain damage as a result of a hospital’s failure to timely diagnose and treat bacterial meningitis.  In March, 2009, Christopher Seeger and Mr. Albert obtained a $1.4 million verdict after a trial in the Supreme Court, New York County on behalf of a 53 year old woman who sustained a serious ankle injury as a result of a slip and fall accident at the Met Life Building in Manhattan.  Also in March, Mr. Albert obtained a $1.3 million settlement for the family of a 43 year old woman who tragically died following a negligently performed neurosurgical procedure.

Mr. Albert has also been lauded nationally for his staunch representation of a 21 year old female client, Maria B., who was viciously assaulted and raped inside the New York City Transit Authority’s 21st Street/Van Alst Subway Station while at least two Transit employees stood by without rendering assistance. The case triggered an outpouring of emotion from New York citizens, who were outraged at the inaction of the Transit personnel, and Mr. Albert has been interviewed by various news sources, including The Today Show, CNN, MSNBC, Inside Edition, CBSTV News, ABCTV News, The New York Post and The Daily News in connection with his involvement in the case.

Mr. Albert has also been instrumental in the firm’s representation of 12 victims and their families in the tragic Windsor Wildcats Bus Accident case. The accident, which occurred when the Coach Canada bus carrying an under 21 year old female hockey team struck a parked tractor trailer on Route I-390 near Rochester, resulted in four deaths and countless serious injuries. In June, 2009, together with Chris Seeger and Moshe Horn, Mr. Albert represented the Wildcats in a liability jury trial which would determine percentages of fault for the accident. During the trial and as the defendant bus driver, Ryan Comfort, was about to be called to the witness stand, the bus and tractor trailer defendants stipulated to a 90/10 liability split that would guarantee the injured plaintiffs 100 percent of their damages.

This victory was followed by one even more significant. In March, 2010, the first damages trial of the 22 injury and death claims filed relating to this tragic accident were scheduled by Judge Thomas VanStrydonck to move forward. Seeger Weiss clients Carly Labadie, Torey Gault and Jason Mailloux were chosen by the Court to be the first case tried. Mr. Albert and Moshe Horn formed the Seeger Weiss trial team.

During the course of the 6 day trial, counsel for the defendants repeatedly referred to Ms. Labadie, Ms. Gault and Mr. Mailloux as "the lucky ones", noting that these plaintiffs had not suffered any broken bones, required any surgeries or necessitated any significant hospitalizations. Several attempts were made by the defendants to compare the injuries of these three plaintiffs to those of several of their teammates who had suffered catastrophic injuries or had been killed in the accident.

However, through gripping testimony from the injured plaintiffs and expert testimony from treating psychiatrists, psychologists and orthopedic surgeons, Mr. Albert and Mr. Horn demonstrated the severity of the injuries suffered by these three clients. In addition to the physical injuries suffered, overwhelming evidence was put before the jury showing that the emotional injuries suffered by Ms. Labadie, Ms. Gault and Mr. Mailloux were extremely serious and greatly affected their ability to enjoy their lives. On March 8, 2010, the Livingston County jury came back with a $2.25 million verdict for Seeger Weiss's three clients. The verdict, which was among the highest ever given by a jury in Livingston County, received extensive coverage from television, radio and print news sources in both New York and Canada. Some nineteen damages trials remain, including three wrongful death cases and multiple catastrophic injury cases.

In July 2010, Mr. Albert obtained a $1.7 million medical malpractice settlement on behalf of a client who was diagnosed with end-stage renal disease, only after his physician failed to recognize signs of kidney disease and increasingly alarming blood test results over an almost two year period.

Also in July 2010, Mr. Albert obtained a $730,000 medical malpractice settlement in a case pending in Circuit Court, Arlington Country, Virginia, on behalf of a 21-year-old client who suffered serious injuries when his peripheral vascular disease was not diagnosed and treated by his primary care physician in a timely manner.
