Recent Developments

On September 6, 2007, the New Jersey Supreme Court reversed the Superior Court's decision certifying the certification of the class. As a result Local 68 is no longer permitted to represent the interests of other VIOXX players in the litigation. If you already have counsel concerning any actual or potential claims you may have relating to your purchase or reimbursement for VIOXX, then the impact of this ruling on your claims, are a matter for you and your counsel to discuss. If you do not have counsel, however, please understand that the New Jersey Supreme Court’s decision may affect the time within which you have to pursue a claim for your VIOXX purchases or reimbursements. The impact of the decision on applicable statutes of limitations can be a complex analysis and one that may benefit from consultation with counsel.
